Terms of service

Notice. This page presents the standard structure of our terms of service. The legally binding contract is the version signed at account creation and available in your customer portal. For our DPA in French and governed by the Civil Code of Québec, contact legal@beluga.quebec.

1. Parties and definitions

"Béluga" refers to the service operated by Technologies Shelter-Bay inc., a corporation under the Québec Business Corporations Act. "Customer" refers to any organization or person that signs up for or pays for a Béluga plan.

2. Acceptable use

Customers agree to use Béluga in compliance with applicable Québec and Canadian law. Prohibited activities include sending unsolicited bulk messages (spam), distributing malicious software, infringing intellectual property, harassment, and any use that interferes with the service for other customers.

3. Service availability

We commit to a service-level agreement that depends on your plan: 99.5% (Affaires), 99.8% (Public), 99.9% (Public with dedicated cluster). Maintenance windows are announced at least 72 hours in advance, except for security-critical patches.

4. Data ownership and portability

Your data is yours. At any time, you can export your full content in standard formats (mbox, vCard, iCal, native files). Béluga retains no rights over your content beyond what is required to operate the service.

5. Confidentiality and surveillance

Béluga does not read, analyze or train models on your content. We do not share data with third parties except where ordered by a Québec or Canadian court following due process. We notify the customer of any such request within the limits permitted by law.

6. Pricing and payment

Prices are in Canadian dollars and exclude applicable taxes (GST/QST). Pricing is guaranteed for a minimum of 36 months from the date of signature on Standard, Pro and Public plans. Payment is processed by Stripe and Moneris.

7. Termination

You can terminate your subscription at any time. Monthly plans end at the close of the current billing cycle; annual plans run to their term. Upon termination, you have 30 days to export your data; thereafter it is permanently destroyed.

8. Liability

Béluga's aggregate liability under any contract is limited to the amounts paid by the customer over the preceding twelve months, except in cases of gross negligence or willful misconduct. Indirect, consequential and punitive damages are excluded to the extent permitted by Québec law.

9. Modifications

We may update these terms at any time. Material changes are notified by email at least 30 days before they take effect. Continued use after that date constitutes acceptance.

10. Governing law and forum

These terms are governed by the laws of Québec and the federal laws of Canada applicable in Québec. Any dispute is submitted exclusively to the courts of the judicial district of Montréal.
